These general Terms and Conditions apply to all contracts entered into with Studio Roka GmbH.

Please read these terms and conditions carefully before using www.studio-roka.com.

PRODUCTS

INFORMATION ON STOCK AVAILABILITY

Product availability corresponds to the availability of products on our online shop. If you wish to be notified about the availability of an item you may contact us at hello@studio-roka.com if you do not see a product you are looking for on our website. Please note that we do not guarantee that all products featured on the website are in stock or available for purchase. We reserve the right to discontinue selling a product.

CHANGING OR CANCELLING AN ORDER

Once an order has been placed, it is no longer possible to adjust, cancel, or add to your order. We advise you to place a new order for the desired item(s). Once an order has been placed, it cannot be canceled.

ORDER CONFIRMATION AND STATUS

You will receive an email to confirm your order as soon as the payment is approved.

CHANGING YOUR CONTACT DETAILS

If there are any changes needed to contact and/or address information, you may contact us at hello@studio-roka.com. Please note that longer delivery times may apply due to any changes made after your order has been placed.

CHANGE YOUR PAYMENT DETAILS

Once your order has been placed, you can no longer change your payment details.

PRICES PRODUCTS

All prices are indicated in CHF (Swiss Francs), and all taxes are included. The prices applied are those shown on the website at the time of ordering.

LIABILITY

Any liability arising in connection with the sale or delivery of Studio Roka GmbH's products or the use of this website is limited to the extent possible under applicable law. The potential claim amount due to Studio Roka GmbH's liability is further limited to the purchase price of the sold product in question.

Studio Roka GmbH does not assume any liability for descriptions provided by third parties, particularly customers within the framework of the online shop or our social media presence published customer reviews.

COMMUNICATION

All communication with us is electronic. When you send us an email or visit our website, you are communicating with us. By subscribing to our newsletter on our website, you will receive regular emails from us. We will continue to communicate with you by posting news and notices on our website and by sending you emails. You also agree that all notices, disclosures, agreements, and other communications we provide to you electronically meet the legal requirements for such communications to be in writing.

MEMBERSHIPS

Membership applications are to be submitted in writing. By signing the application, the Member acknowledges the General Terms and Conditions. Applications are considered in the order they are received and confirmed in writing.

Membership is valid upon receipt of written confirmation (email) and acknowledgment of the general terms and conditions, which are signed by hand.

If a Member wishes to bring a guest, this must be notified to the Studio Roka Staff in advance. The Member is responsible for ensuring that the studio is properly left.

Members are free to use the studio as often as they like. Each member of Studio Roka GmbH is allocated their own shelf in the studio designated for pottery ware. Temporary use of shared shelves is also possible if needed. All materials and utensils belonging to the member and not owned by Studio Roka GmbH must be stored on their designated shelf.

PAUSING MEMBERSHIP

Memberships of 3 months can not be interrupted. Memberships of 6 months can be paused once for a period of 2 consecutive weeks. Memberships with a duration of one year can be paused once for a period of one full month.

If a member experiences illness, accident, or maternity leave, the Membership may be paused for the duration of their absence. This should be promptly communicated to the Studio Roka Team in writing.

PRICES FOR MEMBERSHIPS

The valid prices are listed on the website www.studio-roka.ch. Studio Roka GmbH reserves the right to increase Membership prices if necessary.

MATERIAL MEMBERSHIP

Material costs are acquired at the studio. Clay costs CHF 32 per kilogram, inclusive of both firings and glazes. Porcelain is priced at CHF 34 per kilogram. Recycled clay incurs a charge of CHF 4 per kilogram. Payment is made before leaving the studio via Twint or in cash.
Studio Roka GmbH does not permit the use of clay bodies other than those provided by Studio Roka.

Members are permitted to bring their own glazes, but it is expected that these will be tested beforehand. The member is responsible for any damages caused by glazes not provided by Studio Roka GmbH. The cost per kilogram of clay does not decrease when using personal glazes.

PAYMENT MEMBERSHIPS

The costs for memberships are invoiced once before the start of the membership and cannot be retroactively applied to a longer subscription.

MEMBERHIP CANCELLATION

The contract between the Member and Studio Roka GmbH for Membership is binding for the agreed term. Early termination of the subscription is not possible unless there is a significant reason. Membership fees are non-refundable in the event that a member chooses not to utilize their membership at the studio anymore.

OPENING HOURS & ACCESS

Studio Roka GmbH reserves the right to vary the opening hours depending on the occasion (courses, workshops, special events, etc.). The studio is generally accessible from 06:00 in the morning until 24:00 at night.
Members are required to use the main entrance to access the studio. If a class or event is underway upon arrival, members are expected to maintain quiet behavior and utilize the workspace in the basement. Each member will be provided with a personalized access code to the studio, which must not, under any circumstances, be shared with third parties.

SAEFTY

Members enter Studio Roka at their own risk and are aware of the risk of injury and
Illnesses that may arise from careless behavior in a pottery studio.

The kilns are operated exclusively by the Studio Roka Staff and are never to be opened by members. If Studio Roka discovers that kilns have been opened by a member, we reserve the right to not renew their membership. Studio Roka GmbH reserve the right not to fire items where the glazes have not been properly applied.

INSURANCE

Studio Roka GmbH generally disclaims all liability should personal items be lost or damaged in the studio. In the context of all activities at Studio Roka GmbH, the conclusion of accident insurance and personal liability insurance is the responsibility of the Members. Studio Roka GmbH disclaims any liability for injuries or accidents.

CLASSES, COURSES & OPEN ATELIER

CANCELLATION & REFUND

All classes and courses must be cancelled either directly through the form or via email.

Wheel Crash Courses: The following policy applies. Full refund or free rescheduling for cancelations prior to 48h. 50% refund in cancellations within 24-48h. No refund or rescheduling possible within 24h prior appointment.

Wheel Classes: Full refund or free rescheduling for cancelations prior to 10 days in advance. No refund or rescheduling possible within 10 days prior appointment.

OPEN ATELIER: Full refund or free rescheduling for cancelations prior to 48h. No refund or rescheduling possible within 48h prior appointment.

MISSED COURSE SESSIONS

If you miss a class, the Studio Roka team ensures that you catch up with your group so you can participate in your class as usual. If needed we finish your pieces for you. If you are unable to glaze with your class, you can make up your glazing class in another group. If participants cannot attend all sessions, there is no entitlement to a discount on the course fee.

GENERAL

APPLICABLE LAW AND JURISDICTION

This agreement and all legal relationships hereunder are governed by Swiss Law. The United Nations Convention for the International Sale of Products (CISG) is not applicable. With regard to customer contracts, this choice of law applies only to the extent that the protection granted by mandatory provisions of the law of the state in which the customer has his habitual residence is not withdrawn.

The courts of Zurich, Switzerland, have exclusive jurisdiction over any dispute in connection with this agreement. With regard to customer contracts, the courts at the customer’s domicile in Switzerland have exclusive jurisdiction.

CHANGES TO TERMS AND CONDITIONS

Studio Roka GmbH reserves the right to change, update, or replace any part of these terms and conditions at any time without notification.
